Text messages and calls
Effective November 2, 2026. This notice is part of our Terms of Service and Privacy notice. It states the rules that govern every text message and call that Clarté sends to you or receives from you, and your rights in relation to them.
1. Status of text messaging
1.1 Text messaging has not started. As of the effective date, Clarté does not send text messages to clients, leads, hosts, partners or team members. We confirm bookings and communicate through the Clarté app, your account and email. This notice sets out the terms that will govern text messaging from the first day on which we begin it.
1.2 Commitment. We shall send no text message to any mobile number unless, before the first message, (a) we have obtained and recorded the consent that this notice requires for that kind of message, (b) our messaging provider and our sending number have been registered with the wireless carriers as the carriers require, and (c) the opt-out and help functions described in Section 7 have been tested and are working. If we begin text messaging, we shall say so on this page by updating the version history in Section 24 and by announcing it in the app before the first message is sent.
1.3 Calls. The parts of this notice that concern telephone calls (Section 16) apply now, to any call we place or receive.
2. Definitions and interpretation
2.1 Defined terms. In this notice: “Clarté”, “we” and “us” mean LIKE A KING INC., a New York corporation doing business in California as Clarté; “you” means the individual who provides a mobile number to us or whose number we use; “Message” means a text message, including SMS and MMS, sent to a mobile number; “Service Message” means a Message that relates to a booking, an account, a consultation request or another transaction that you have requested, as described in Section 5; “Marketing Message” means a Message that encourages the purchase or rental of, or investment in, our services or products, or that advertises them, including a promotion, a discount or a referral offer; “Security Message” means a one-time passcode or sign-in alert; “Program” means the Clarté text messaging program described in this notice; “Consent Record” has the meaning in Section 9; “Opt-Out Keyword” means any word listed in Section 8; “Quiet Hours” means the hours described in Section 10; “Business Day” means any day other than a Saturday, a Sunday or a state or federal holiday; “Provider” means the messaging service provider that we use to deliver Messages; and “Carrier” means a wireless carrier or messaging network.
2.2 Statutes. “TCPA” means the Telephone Consumer Protection Act of 1991 (47 U.S.C. § 227) and the rules of the Federal Communications Commission under it (47 C.F.R. § 64.1200). “CCPA” means the California Consumer Privacy Act of 2018 as amended (Cal. Civ. Code § 1798.100 and following). “CIPA” means the California Invasion of Privacy Act (Cal. Penal Code § 630 and following).
2.3 Interpretation. Headings are for convenience only. “Including” means “including without limitation”. A reference to a law includes it as amended or replaced. Where this notice and the law give different protection, the rule that is more protective of you applies. Nothing in this notice limits a right that the law gives you and that cannot be waived.
3. Legal framework
3.1 Federal. The TCPA and the FCC’s rules restrict calls and texts made with an automatic telephone dialing system or an artificial or prerecorded voice to a mobile number, and calls and texts that are telemarketing or advertising. They require prior express consent for informational messages, prior express written consent for marketing messages sent by automated means, honoring of a revocation of consent in any reasonable manner, calling hours of 8 a.m. to 9 p.m. in the recipient’s local time for telemarketing, and a written internal do-not-call policy (47 C.F.R. § 64.1200(a), (c), (d) and (a)(10)). The FCC has ruled that a voice generated by artificial intelligence is an “artificial voice” for the purposes of the TCPA (Declaratory Ruling, FCC 24-17, February 2024).
3.2 California. California law adds its own rules on telephone solicitation (Cal. Bus. & Prof. Code § 17590 and following), on automatic dialing and announcing devices (Cal. Pub. Util. Code § 2871 and following), on recording calls (Cal. Penal Code §§ 632 and 632.7), on unfair and deceptive practices (Cal. Bus. & Prof. Code § 17200; Cal. Civ. Code § 1770), and on privacy (the CCPA and Cal. Const. art. I, § 1). Where the rules differ, we follow the stricter.
3.3 Industry standards. We follow the CTIA Messaging Principles and Best Practices and the registration, content and opt-out requirements of the Carriers and the Provider.
3.4 Electronic consent. Consent that you give electronically has the same effect as a signed writing under the federal E-SIGN Act (15 U.S.C. § 7001) and the California Uniform Electronic Transactions Act (Cal. Civ. Code § 1633.1 and following).
4. The Program in brief
| Item | Statement |
|---|---|
| Program name and sender | Clarté, operated by LIKE A KING INC. Each Message identifies Clarté by name. |
| Who may join | Individuals aged 18 and over who give us a mobile number that they own or have authority to use. |
| Message types | Service Messages (booking confirmations, reminders, arrival and schedule updates, receipts, replies to your questions); Security Messages; and, only with separate consent, Marketing Messages. |
| Frequency | Service Messages: as needed for your bookings, typically no more than six per visit. Marketing Messages: no more than four per calendar month. |
| Cost | We charge nothing for Messages. Message and data rates from your Carrier may apply. |
| Stop | Reply STOP to any Message. |
| Help | Reply HELP to any Message, or use the contact form. |
| Supported Carriers | Major U.S. Carriers. Delivery is not guaranteed (Section 15). |
| Conditions | Marketing consent is not a condition of any purchase or service. |
5. Kinds of Messages and the consent each requires
5.1 Service Messages. A Service Message relates to a transaction or request that you made. Examples: “Your Clarté visit is confirmed for Tuesday between 9 and 11 a.m.”; “Your team is on the way”; “Your receipt is ready”; and a reply to a question you asked. A Service Message contains no advertisement and no solicitation, except for a brief, non-promotional reference to our name.
5.2 Consent for Service Messages. We send Service Messages only if you have given us your mobile number for the booking, account or request in question, and have agreed, by an unchecked box or equivalent action at the point where you gave the number, to receive text messages about it. By doing so you give prior express consent to receive Service Messages that are within the scope of that transaction. This consent is not consent to Marketing Messages.
5.3 Security Messages. We send a one-time passcode or sign-in alert only when you or someone using your account has just requested it, and the Message contains the passcode and the purpose, and nothing else.
5.4 Marketing Messages. We send a Marketing Message only if you have given prior express written consent, by a separate, clearly labeled, unchecked box or other affirmative action, on a page that discloses the identity of the sender, that Messages may be sent using automated technology, the frequency, that consent is not a condition of any purchase, that rates may apply, and how to opt out. The consent applies to Marketing Messages from Clarté only.
5.5 Mixed Messages. If a Message contains both transactional and promotional content, we treat it as a Marketing Message and send it only to a person who has given marketing consent.
5.6 Team members. Text messages to our employees about schedules, safety and work matters are governed by the employee’s employment documents and by the law of employment. They are not Marketing Messages. A team member may withdraw consent to work texts, and time spent responding while off the clock is paid time.
5.7 Partners and hosts. A partner business or short-term-rental host may receive Service Messages about bookings it has placed or accepted, on the same terms as a client.
6. How consent is requested
6.1 At the point of collection. Where we ask for a mobile number (for example on the booking page or when you open an account), we show beside the field, in plain words, what you are agreeing to, before you submit. Consent is requested through unchecked checkboxes. We do not preselect a box, we do not bury consent in a long document, and we do not treat the mere entry of a number as consent to Marketing Messages.
6.2 Confirmation. After you opt in to the Program, we send one confirmation Message that identifies Clarté, describes the Program, states the frequency, states that rates may apply, and tells you how to stop and get help. For Marketing Messages we use a double opt-in: we send a Message asking you to reply YES to confirm, and we send no Marketing Message until you do.
6.3 Who may consent. Only the subscriber or customary user of a mobile number may give consent for it. You promise that you are that person. If you share the number or it changes hands, Section 13 applies.
6.4 Minors. We do not knowingly send Messages to persons under 18, and we do not accept consent from them.
6.5 Third-party leads. We do not buy, rent or accept lists of mobile numbers, and we do not send Messages on the basis of consent that someone else collected for another company.
6.6 No sale of consent. We do not sell, rent or share your mobile number or your opt-in consent with third parties or affiliates for their own marketing. The Provider and the Carriers handle your number only to deliver our Messages.
7. What Messages may and may not contain
7.1 Identification. Each Message identifies Clarté by name. Each Marketing Message includes the instruction “Reply STOP to opt out.”
7.2 No sensitive content. Messages do not contain gate codes, door codes, alarm codes, passwords, full card numbers, government identification numbers or health information. If you send such information to us by text, we shall ask you to use the secure access-notes field in the app instead, and we shall delete the text from our systems where we can.
7.3 Links. Messages may contain links to pages on theclarte.pro. We do not use shortened links that hide the destination, and we never ask you to enter a password through a link in a Message. If a link or a request looks suspicious, do not follow it, and tell us through the contact form.
7.4 Prohibited content. We do not send content that is unlawful, deceptive, harassing, sexually explicit, or related to prohibited categories under Carrier rules (such as illegal drugs, gambling or high-risk financial offers).
7.5 AI-generated Messages. A Message that an artificial intelligence system writes is reviewed by a person at Clarté before it is sent, unless it is a fixed template. The Clarté AI characters (see the AI disclosure) do not send text messages by themselves. Any text you receive after a consultation request is sent by us in the manner this notice describes.
8. Stopping Messages: STOP, HELP and other ways to revoke
8.1 STOP. You may revoke consent at any time, in any reasonable manner. The simplest is to reply STOP to any Message. We also treat STOP ALL, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE and OPT OUT as Opt-Out Keywords, in upper or lower case, alone or in a short sentence such as “please stop texting me”. A reasonable alternative is to tell us through the contact form, to change the setting in your account, or to tell a member of our team.
8.2 What we do. We shall (a) stop sending Messages of the kind you have stopped as soon as practicable and in any event within 10 Business Days of your request (our systems apply it immediately); (b) send you one final Message confirming your opt-out, to which no promotional content is added and which we send within five minutes of your request; and (c) add your number to our suppression list so that it is not used for the Program again unless you opt in again.
8.3 Scope. A STOP reply to a Marketing Message stops Marketing Messages. We shall also treat it as revoking consent for Service Messages unless you tell us otherwise, except that we may send you a single clarifying Message if you have a booking scheduled within the next 48 hours, so that you understand that you will no longer receive texts about it. We shall use the app and email to give you the same information. If you have asked to stop all texts, we shall stop all texts.
8.4 HELP. Reply HELP to any Message and we shall reply with a short Message identifying Clarté and telling you how to reach us through the contact form and how to stop.
8.5 START. If you stopped and wish to resume, reply START or opt in again through the app. We do not treat START as consent to Marketing Messages unless you also consent as Section 5.4 requires.
8.6 No penalty. We do not charge a fee, require a reason, or degrade a service because you stop Messages. We may not send you a Message to persuade you to reconsider after you have stopped, other than the confirmation described above.
8.7 Opting out by calling. If you tell us on a call that you do not want to receive Messages, we treat it as a revocation, record it in the same way, and apply Section 8.2.
9. Consent records and recordkeeping
9.1 The Consent Record. For each number for which we hold consent we keep a record (the “Consent Record”) of: the mobile number; the date and time of consent (to the second, in Pacific time and in UTC); the page or form on which it was given and the exact wording shown, by version; the kind of consent (Service, Security or Marketing); the method (checkbox, double opt-in reply or other); a one-way hash of the IP address and browser details of the device used; and, for each revocation, its date, time, channel and the keyword or words used.
9.2 Retention. We keep each Consent Record for as long as the consent is in effect and for five years after it ends, which exceeds the four-year limitation period that applies to claims under the TCPA (28 U.S.C. § 1658(a)), so that we can show that a Message was authorized or that an opt-out was honored. We keep the suppression entry for a revoked number permanently, as a bare number with the date of revocation and no other information, so that the number is never used again by mistake.
9.3 Message logs. We keep a log of Messages sent (date, time, number, template version and delivery status) for 24 months, and the content of Marketing Messages for five years. We do not keep inbound Message content beyond what is needed to answer you and to document a request, and not beyond 24 months.
9.4 Your access. You may ask for a copy of the Consent Record and the Message log for your number, through the contact form, subject to verification that you control the number. We respond within 45 days.
9.5 Legal hold. If a claim, complaint or inquiry concerns a Message, we suspend deletion of the related records until the matter is resolved.
10. Quiet Hours and timing
10.1 Hours. We send Marketing Messages only between 8 a.m. and 9 p.m. in your local time. We determine your local time from the time zone for the area code or ZIP code you gave us, or, if we know a better location, from that. If we cannot determine it, we use Pacific time and apply the narrower of the two possible windows.
10.2 Service Messages. We send Service Messages in the same hours, except for a Message about a visit that is under way or begins within two hours, a safety matter, or a Security Message that you have just requested.
10.3 Holidays. We do not send Marketing Messages on Thanksgiving Day, Christmas Day or New Year’s Day.
10.4 Delays. If a Message is delayed by a Carrier so that it arrives outside the hours above, the delay is not a breach of this Section, but we shall treat it as a reason to review our scheduling.
11. Frequency limits
Service Messages are sent only as needed. In ordinary use, a visit produces no more than six Messages (confirmation, reminder the day before, a message that the team is on the way, a message that the visit is finished, a receipt notice, and, if requested, a follow-up). We send no more than four Marketing Messages in any calendar month, and no more than one in any 24-hour period. We shall reduce frequency if you ask us to.
12. Delivery, errors and the content of replies
12.1 Replies. If you reply to a Message with a question, a person at Clarté or an assistant that identifies itself as an AI replies to you. We shall reply by Message, by the app, or by email, as you prefer.
12.2 Errors. If a Message contains an error (for example a wrong time), we shall correct it by a further Message and, for a schedule change, we shall also confirm it in the app. A Message does not change the terms of a booking unless it says that it does and a person at Clarté has confirmed it; the booking confirmation in your account controls.
12.3 No reliance on delivery. A reminder Message is a courtesy. Your booking is governed by the booking confirmation in your account and by our Cancellation and refund policy, whether or not you received a Message.
13. Changed, reassigned and shared numbers
13.1 Your duty. If you change or give up a mobile number, please tell us through your account, so that Messages do not reach another person. If you receive a Message that was intended for someone else, reply STOP and tell us through the contact form.
13.2 Our checks. Before sending Messages to a number for which our consent is more than 90 days old, we check the FCC’s Reassigned Numbers Database (47 C.F.R. § 64.1200(m)) where the Provider makes it available, and we suppress the number if it has been reassigned since the date of consent.
13.3 Wrong-number reports. If a person tells us that a number does not belong to the person who consented, we stop sending Messages to it at once and record that fact.
13.4 Shared numbers. A household or business that shares one number is responsible for ensuring that each person who may read the Messages is aware of them. You must not give us a number belonging to someone else without that person’s permission.
14. Privacy of your number and the CCPA
14.1 Use. We use your mobile number only to communicate with you as this notice describes, to verify your identity, to keep your account secure and to comply with law. We do not use it to track your location.
14.2 No sale or sharing. We do not sell or share (as those terms are defined in the CCPA) your mobile number or your opt-in consent. The Provider is our service provider. It may process your number and the content of Messages only on our behalf, under a written contract that complies with Cal. Civ. Code § 1798.100(d) and § 1798.140(ag).
14.3 Your rights. You have the rights described in the Privacy notice, including to know, delete and correct information we hold about you. If you ask us to delete your information, we keep only the suppression entry described in Section 9.2, which the law allows because it is needed to honor your opt-out.
14.4 Retention. See Section 9.
15. Carriers, the Provider and delivery
15.1 Carriers are not liable. Wireless Carriers and their affiliates are not liable for delayed or undelivered Messages. Delivery depends on your Carrier, your device and your coverage, and is not guaranteed.
15.2 Rates. Message and data rates from your Carrier may apply. We do not charge you for Messages and we are not responsible for charges from your Carrier. If you are concerned about charges, you may stop Messages at any time.
15.3 Filtering. Carriers may filter or block Messages for their own reasons. We do not use tools to evade those filters.
15.4 Availability. The Program may be paused for maintenance, by a Carrier, or by the Provider, and we shall use the app and email in that case.
16. Calls
16.1 Recorded calls. Calls with Clarté may be recorded for quality, training and record-keeping. We shall tell you at the start of a recorded call, as California Penal Code sections 632 and 632.7 require. If you stay on the line after the notice, you consent to the recording. If you prefer not to be recorded, say so at once and we shall continue through the contact form, the app or another unrecorded channel, and we shall not treat your request as a reason to refuse service.
16.2 Call-back and voicemail. We may call or leave a voicemail about a booking at the number you gave us. A voicemail identifies Clarté and the reason for the call and does not contain sensitive details.
16.3 Do Not Call. We do not make telemarketing calls to numbers on the National Do Not Call Registry or on our internal do-not-call list, except as the law allows (for example, to clients with whom we have an established business relationship, within the periods the law provides, or with your written consent). We keep a written do-not-call policy and train our team in it (47 C.F.R. § 64.1200(d)). You may ask to be placed on our internal list at any time through the contact form; we apply the request within 10 Business Days and keep it for at least five years.
16.4 Calling hours. We make telemarketing calls only between 8 a.m. and 9 p.m. in your local time.
16.5 Your recordings. You may not record calls with us or with our team without notifying all parties, as Section 6 of the Terms of Service states and as Penal Code section 632 requires.
16.6 Calls placed by team members. Team members do not use personal telephone numbers to call or text clients about bookings. They use the app’s communication tools, so that your number is not exposed and so that the contact is part of the booking record.
17. Artificial intelligence and automated voice
17.1 The Concierge. The Clarté AI team on the website and in the app is an AI assistant and says so (Cal. Bus. & Prof. Code §§ 17940 to 17943). It does not send text messages or place calls by itself.
17.2 Automated or AI-generated voice calls. If we ever place a call that uses an automated, prerecorded or AI-generated voice, we shall do so only to a number for which we have the consent the TCPA requires for that kind of call, we shall say at the start of the call that the voice is artificial, and we shall give an automated opt-out that works throughout the call. We make no such calls today.
17.3 AI voice in the app. The AI characters may speak in the app. That is a feature inside the app, not a telephone call or a text message, and it is described in the AI disclosure.
18. Worked examples
Example 1: Booking with Service Messages only. You enter your mobile number on the booking page and tick the box that says you agree to receive texts about this booking. You do not tick the separate marketing box. We send a confirmation, a reminder and an arrival text. We send no promotion. After the visit, we send a receipt notice and no more. Your consent is recorded as Service consent.
Example 2: Texting STOP the day before a visit. You reply STOP to a reminder. Within five minutes you receive one confirming Message. We stop sending Messages to you. Because you have a booking the next day, the app and email carry the arrival information, and we do not text you again unless you opt in.
Example 3: You reply “Please do not text me anymore, call me instead”. That is a reasonable revocation in words, even though it is not a keyword. We stop texting you, record the request, and add a note that you prefer calls for your bookings. A person confirms by a call or by email.
Example 4: A marketing offer arrives at 9:40 p.m. That would breach Section 10. If it happens because of a Carrier delay, we shall review it. If it was our error, tell us through the contact form; we shall record the incident, suppress your number from Marketing Messages and tell you what we found.
Example 5: Someone else’s text. You receive “Your Clarté visit is confirmed”, but you are not a client. Reply STOP and tell us through the contact form. We shall add your number to the suppression list and check how the number came to be used.
Example 6: A sign-in passcode. You request a code to sign in. We send one Message with the code and the purpose. It is a Security Message and requires no marketing consent. If you did not request it, ignore it, and tell us.
Example 7: A team member texts you from a personal phone. That is against our policy (Section 16.6). Tell us through the contact form. We shall not treat your report as grounds to refuse service and we shall address it with the team member.
19. Complaints and escalation ladder
19.1 Step 1: the contact form. Tell us about a Message or call you did not want, or that you think breached this notice. A person reviews it within 10 Business Days and tells you what they found.
19.2 Step 2: reconsideration. If you disagree, ask again through the same form. A different person reviews it, with the Consent Record, and answers within a further 10 Business Days.
19.3 Step 3: regulators. You may complain to the Federal Communications Commission, the Federal Trade Commission, the California Attorney General or the California Privacy Protection Agency at any time.
19.4 Step 4: the Terms. You may use the dispute resolution procedure in the Terms of Service. You may skip any step.
20. Accessibility
Messages are written in plain language, avoid unnecessary abbreviations and emoji, and do not rely on color or images to carry meaning. If you cannot use text messaging because of a disability, tell us through the contact form and we shall use email, the app or a call instead. See the Accessibility statement.
21. Security and scams
We never ask you by text for a password, a full card number, a Social Security number or an alarm code. Messages from us come from the sender identity we register with the Carriers and name Clarté. If you receive a text that claims to be from us and asks for payment or personal information, do not respond, and tell us through the contact form.
22. Interaction with other documents
22.1 Order of precedence. This notice is incorporated into the Terms of Service and the Privacy notice. If it conflicts with the Terms of Service, this notice controls on text messages and calls. Nothing in the Terms of Service reduces a right that this notice or the law gives you.
22.2 Disputes. Disputes about Messages and calls are resolved as the Terms of Service provide in their section on dispute resolution and arbitration, including your right to opt out and to use small-claims court. Nothing in this notice waives any right under the TCPA, the Consumers Legal Remedies Act or any other law that cannot be waived.
22.3 Limitation. To the extent permitted by law, we are not liable for indirect or consequential damages from a delayed or undelivered Message, and nothing in this notice limits liability for violation of law, fraud, willful injury or gross negligence (Cal. Civ. Code § 1668).
23. Changes, severability and survival
23.1 Changes. We may change this notice. Changes apply to Messages sent after the effective date of the change; they do not change your right to opt out. If a change would expand the kinds of Messages we send, we shall obtain fresh consent first.
23.2 Severability. If any provision is unenforceable, it is limited to the extent necessary and the rest remains in effect.
23.3 Survival. Sections 9, 14, 19, 22 and this Section survive the end of your use of the Program.
